The Newcastle Network LP and its affiliates (“Newcastle”, “we” or “us”) are committed to protecting the privacy of our website visitors. This privacy policy (“Privacy Policy”) seeks to help you understand whether and how we collect information about you when you visit our website (the “Site”), and how we use such information. This Privacy Policy does not address our privacy practices concerning any nonpublic personal information we collect as to our investors; we address those practices in separate notices sent to our investors or potential investors.

This Privacy Policy applies when you visit the Site and may be updated at any time. This Privacy Policy and each updated version will be effective upon posting. As such, we urge you to review this Privacy Policy each time you visit the Site. Your Information

When you use the Site, you will have the option to voluntarily submit information to our website that relates to you personally, including your name and e-mail (“PII”). Unless specifically requested, Newcastle does not solicit, nor does Newcastle wish to receive, any confidential, secret or proprietary information or other material from you through this website, by e-mail, through the “Contact Us” feature, or in any other way.  Any materials submitted or sent on or through this website in any manner (collectively, “Submitted Materials”) will be deemed not to be confidential or secret, and may be used by us in any manner consistent with these Terms of Use and our Privacy Policy.  By submitting any Submitted Materials to us, you: (i) represent and warrant that you either own your Submitted Materials, or that you have the necessary licenses, rights, consents and permissions to use such Submitted Materials and submit them to this website; and (ii) you grant Newcastle a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully transferable, assignable and sub-licensable right and license to use such material (in whole or part) in any manner and/or to incorporate it (in whole or in part) in other works (including, without limitation, this website), products or services in any form, media, or technology now known or later developed.  Newcastle is not obligated to review any Submitted Materials.  Newcastle cannot be responsible for maintaining any Submitted Material you provide to this website, and we may delete or destroy any such Submitted Material at any time. 

Disclosure of Information

You acknowledge and agree that we may disclose PII under any of the following limited circumstances:

  • When we believe that such disclosures are required by law, regulation, legal process, subpoena, document request or governmental request, or when we otherwise believe in good faith that such disclosure is necessary or appropriate in connection with any activity that violates the law (including relating to intellectual property, fraud, contracts and privacy) or may expose us to liability;

  • If Newcastle merges with or transfers substantially all of its business, stocks or assets to another entity, Newcastle has the right to share your PII with that entity, to the extent lawfully permissible; provided that if such merger or transfer results in a material change in the use of your PII, we will use commercially reasonable efforts (as determined by Newcastle) to provide you with notice of such event and we will request that the new entity follow the practices disclosed in this Privacy Policy or notify you of any changes to it. 

We can (and you authorize us to) disclose any of your information in the above circumstances. We may keep any and all information that we collect for an unlimited period of time.

The security of your information is important to us. We employ security measures to protect any information you provide through our website from unauthorized access or use. You should be aware, however, that “perfect security” does not exist on the Internet, and there is always the risk that unauthorized persons may access or use your information.
